Welcome to Sparsh Mukthi. By accessing or using our touchless control system, website, and services, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

  • By downloading, installing, or using Sparsh Mukthi, you agree to comply with these Terms and Conditions.
  • If you do not agree with any part of these terms, you must discontinue use of our services immediately.
  • These terms apply to all users, including individuals, organizations, and institutions.

2. Service Description

  • Sparsh Mukthi is an AI-powered touchless control system that enables users to operate devices using hand gestures, voice commands, and head tracking.
  • The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.
  • We strive to maintain 99% uptime but do not guarantee uninterrupted service.

3. User Accounts & Registration

  • To access premium features, you may need to create an account with accurate and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years old to use Sparsh Mukthi. Users under 18 require parental consent.
  • Each account is for individual use only. Sharing accounts is strictly prohibited.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription & Payment Terms

  • Free Trial: New users receive a 2-month free trial plus 2 bonus months with no payment required.
  • Paid Plans: After the trial, subscriptions are available at:
    • ₹100/month for single-user plan
    • ₹149/month for dual-user plan
  • Payments are processed securely through Razorpay and other trusted payment gateways.
  • Subscriptions auto-renew unless canceled before the renewal date.
  • All fees are non-refundable except as stated in our Cancellation & Refunds Policy.

5. Acceptable Use Policy

You agree NOT to:

  • Use Sparsh Mukthi for any illegal, harmful, or fraudulent purposes.
  • Reverse engineer, decompile, or attempt to extract the source code.
  • Distribute, sell, or sublicense the software without written permission.
  • Use automated tools (bots, scrapers) to access our services.
  • Circumvent any security features or authentication mechanisms.
  • Upload malicious code, viruses, or harmful content.
  • Impersonate others or misrepresent your affiliation with any entity.
  • Violate any applicable local, national, or international laws.

6. Intellectual Property Rights

  • Sparsh Mukthi, including its logo, design, code, and documentation, is the intellectual property of IntelliKat and its developers.
  • The software is licensed to you, not sold. You receive a non-exclusive, non-transferable license to use it.
  • Our open-source components are governed by the MIT License (see GitHub repository for details).
  • You may not use our trademarks, branding, or logos without prior written consent.

7. Privacy & Data Protection

  • Your privacy is important to us. Please review our Privacy Policy for details on data collection and usage.
  • We process gesture and voice data locally on your device. No biometric data is stored or transmitted.
  • We use Firebase for user authentication and analytics, subject to their privacy policies.

8. Camera & Microphone Usage

  • Sparsh Mukthi requires camera access for gesture recognition and microphone access for voice commands.
  • All processing happens locally on your device in real-time.
  • You may revoke these permissions anytime, though it will disable respective features.
  • We do not record, store, or transmit video or audio data.

9. Disclaimer of Warranties

  • Sparsh Mukthi is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee that the software will be error-free, secure, or continuously available.
  • Use of Sparsh Mukthi in critical environments (medical devices, vehicles, industrial machinery) is at your own risk.
  • We are not liable for any damages arising from software malfunctions, data loss, or service interruptions.

10. Limitation of Liability

  • To the maximum extent permitted by law, IntelliKat and Sparsh Mukthi shall not be liable for any indirect, incidental, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid for the service in the last 12 months.
  • Some jurisdictions do not allow liability limitations, so this may not apply to you.

11. Indemnification

  • You agree to indemnify and hold harmless IntelliKat, its developers, and affiliates from any claims, losses, or damages arising from your use of Sparsh Mukthi or violation of these terms.

12. Third-Party Services

  • Sparsh Mukthi may integrate with third-party services (Firebase, Google APIs, Razorpay, etc.).
  • These services are governed by their own terms and privacy policies.
  • We are not responsible for the actions or policies of third-party providers.

13. Updates & Modifications

  • We may release updates, patches, or new versions of Sparsh Mukthi to improve functionality or security.
  • You agree to install updates promptly. Older versions may not be supported.
  • We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting.

14. Termination

  • You may terminate your account at any time by contacting us or using in-app settings.
  • We may suspend or terminate your access if you violate these terms or engage in abusive behavior.
  • Upon termination, your access to premium features will cease, but you may continue using the free version.

15. Governing Law & Dispute Resolution

  • These Terms and Conditions are governed by the laws of India.
  • Any disputes shall be resolved through good-faith negotiations first.
  • If unresolved, disputes will be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
